1. Deposit and Payment. The Client shall make a deposit to retain the Photographer to perform the services specified above. The Monday prior to the session, the deposit shall be applied to reduce the total cost and Client shall pay the balance due. If the Client refuses to pay for the Order, the product shall not be delivered and the deposit shall be retained as payment for reserving a date and time.
2. Cancellation. Session fees and deposits paid to Aimee Slater Photography shall be deemed non-refundable. If Client requires postponement due to illness in the family, weather, etc, the deposit and session fee shall be transferable to a new date. Photographer agrees to work with Client to the best of their ability to find a new date that works for both parties. (Please notify ASAP if you desire a postponement)
3. Photographic Images. The Photographer is not required to release every frame of image taken from the photography session. The Client understands that the Photographer edits tightly for quality and will provide the best set of images as proofs from the session. The Photographer agrees to provide client with all edited images as proofs to choose the specified digitals based on their package.
4. Copyright and Reproductions. Aimee Slater Photography shall own the copyright in all images created and shall have the exclusive right to make reproductions. It is illegal and unlawful to scan, copy, or reproduce our work in any manner or medium as covered by the Federal Copyright laws. The full-size digital images are released for purchasing prints and for archiving. Backup copies should be made to the Client’s local digital media. The Client is not allowed to sell, public, or otherwise distribute without express written consent from the Photographer. The Photographer may use images from the client for self-promotion via websites, print publication, photo contests, etc unless specifically asked not to.
5. Client’s Usage. The Client is obtaining prints and digital file for personal use only, and shall not sell said prints, digital files or authorize any reproductions thereof by parties other than the Photographer. The photographer is not liable for any differences in print production if Client chooses to print products through anyone other than the recommended lab.
6. Failure to Perform. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, and the parties cannot agree to a new date, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
7. Charges. The package fee is based on the Photographer’s Standard Price List and includes the photographs described above. If the fee is not based on a package but is a session fee, all photographs shall be billed in addition to the fee and in accordance with the Standard Price List. In addition to either the package fee or the session fee, the extra charges agreed upon via communication with client shall be billed if and when incurred.
